General Terms of Sale
PREMISE
The following text ("general conditions of sale") governs the methods and conditions of sale of the products marketed by Moreali Tessile Casa (the "products"). All contracts for the sale of products by Moreali Tessile Casa to third parties (the "customers") are governed by these General Conditions, which form an integral and substantial part of each proposal, order and confirmation of the purchase order for the products themselves. The conditions of sale applicable to the order are those in force on the date of the order itself.
Any modification relating to operations or payment conditions that may be granted in derogation from the General Conditions will be valid only if Moreali Tessile Casa has accepted said condition in writing.
The General Conditions apply to all Customers, except for some provisions applicable exclusively to the Consumer Customer (by "Consumer Customer" we mean a natural person who purchases the products for purposes unrelated to any entrepreneurial or professional activity carried out); it is assumed that the Customer who sends a purchase proposal by entering his VAT number in the area relating to the Customer's personal data is not a "Consumer Customer". Articles 50 to 63 of Legislative Decree no. also apply to Purchase Contracts stipulated by Consumer Customers. 206/2005.
Moreali Tessile Casa may modify, at any time and without notice, the content of the General Conditions referred to in this document: such modifications will take effect from the date of publication on the Site.

PURCHASE PROCEDURE
The order sent by the Customer has the value of a contractual proposal and entails complete knowledge and full acceptance of these General Conditions.
The correct receipt of the Customer's proposal is confirmed by Moreali Tessile Casa through an automatic response sent to the Customer's email address. This automatic email only confirms the correct receipt of the proposal. The confirmation message will indicate the 'Order Number', to be used in any subsequent communication with Moreali Tessile Casa.
As soon as the order is processed, the data contained in the personal area will be updated. Each Purchase Contract stipulated between Moreali Tessile Casa and the Customer must be considered concluded with the acceptance of the order by Moreali Tessile Casa. Moreali Tessile Casa has the right to accept or not, at its own discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason, including compensation, in case of non-acceptance of the order itself. The order is considered accepted by Moreali Tessile Casa if, within 48 hours of sending the order, the Customer receives no further communications. In case of non-acceptance, Moreali Tessile Casa will notify the customer via email.
By sending the order, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the General and Payment Conditions described below.

PRODUCT PRICES - DELIVERY COSTS - PRODUCT AVAILABILITY
All product prices are clearly indicated on the Site and are inclusive of VAT. They do not include any other taxes, duties or duties established by the relevant legislation applicable in the case of importation. In this case the Customer will have to clear the products through customs by paying any duties and taxes (other than VAT) possibly due in the country of importation.
The prices and availability of the products shown on the Site are subject to change at any time and without notice, it being understood that, limited to orders being accepted or already accepted by Moreali Tessile Casa, the conditions of sale in force at the time the order is sent by the Customer.
The availability indicated in the product sheets is not updated in real time; in the event that numerous accesses to the site occur, the actual availability of individual products may vary significantly during the same day compared to the indications shown on the Site. By virtue of these variables Moreali Tessile Casa does not guarantee therefore, the certainty of immediate delivery of the products purchased and indicated as available on the Site and therefore it will in no case be responsible for any delays in delivery.
For payments by bank transfer, Moreali Tessile Casa will send the products only when the relevant amount is credited to the current account held in the name of Moreali Tessile Casa.
If the delivery times of the ordered product are delayed compared to the delivery times indicated on the Site before the order, Moreali Tessile Casa undertakes to promptly notify the Customer via an e-mail message. Until the moment of shipment, the Customer has the right to cancel the order or modify it, exclusively by following the procedures reported in his personal area. The cost of each shipment, the amount of which may vary based on the delivery and payment method as well as the country of destination and the total amount of the order, is added to the overall price of each purchase and is clearly indicated and communicated to the Customer before the conclusion of the Purchase Contract, within the Site.
The visual representation of the products on the Site, where available, normally corresponds to the photographic image of the products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, on the part of Moreali Tessile Casa , regarding the exact correspondence of the image depicted on the Site with the actual product (with particular reference to the actual dimensions and/or chromatic aspects of the products).
The prices and availability of the products shown on the Site are subject to change at any time and without notice, it being understood that, limited to orders being accepted or already accepted by Moreali Tessile Casa, the conditions of sale in force at the time the order is sent by the Customer.

RIGHT OF WITHDRAWAL
The customer-consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity) can exercise the right of withdrawal (and withdraw from the contract for any reason).
To exercise this right, the customer must send Moreali Tessile Casa a communication within 14 working days from the date of delivery of the goods.
Please note: Customers who purchase with a VAT number cannot exercise the right of withdrawal.
The right of withdrawal is however subject to the following conditions:
1. The purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
2. To limit damage to the original packaging we recommend, when possible, placing it in a second box (the application of labels or adhesive tape on the original packaging of the product is prohibited);
3. The shipment, until it arrives in our warehouse, is under the complete responsibility of the customer;
Moreali Tessile Casa is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. Under no circumstances will parcels be collected cash on delivery or freight collect.
To exercise this right, the customer must send Moreali Tessile Casa a communication within 14 working days from the date of delivery of the goods.

REFUND TO CUSTOMER
Without prejudice to any restoration costs for ascertained damage to the packaging, Moreali Tessile Casa will refund the customer the amount already paid for the product, excluding transport costs, through a cancellation procedure for the amount charged on your credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide their bank details (IBAN code).
During the SALES period and for goods in the OCCASIONS department, Moreali Tessile Casa does not provide a cash refund on items discounted from 30% to 50%, but after returning the product, Moreali Tessile Casawill issue a voucher code equal to the value of the returned goods to be used within the calendar year. Shipping costs are always excluded from this voucher.
REFUNDS FOR EXTERNAL EU CLIENTS
The shipping cost for returning the purchased product is borne by the customer and for countries outside the EU the final refund refers to standard refunds.
WHEN DOES THE RIGHT OF WITHDRAWAL EXPIRE
The right of withdrawal lapses in cases in which Moreali Tessile Casa ascertains:
1. Partial use of the asset;
2. The lack of the external packaging and/or the original internal packaging;
3. The absence of integral elements of the product;
4. Damage to the product for reasons other than its transport.
In the cases indicated above, Moreali Tessile Casa will return the purchased goods to the sender, charging the shipping costs to the sender.
COMMUNICATIONS AND COMPLAINTS

4. Damage to the product for reasons other than its transport.
In the cases indicated above, Moreali Tessile Casa will return the purchased goods to the sender, charging the shipping costs to the sender.
COMMUNICATIONS AND COMPLAINTS
All communications or any complaints from the Customer towards Moreali Tessile Casa relating to the Purchase Contracts must be addressed to Customer Service by writing to servizio morealitessilecasa@gmail.com
COMPETENT FORUM
The Purchase Contract between the Customer and Moreali Tessile Casa is understood to be concluded in Italy and governed by Italian law. The Judicial Authority of Modena will be competent for any dispute.
PROCESSING OF PERSONAL DATA (PRIVACY)
