General Terms of Sale
INTRODUCTION
The following text ("general sales conditions") governs the methods and conditions of sale of the products marketed by Moreali Tessile Casa (the "products"). All contracts for the sale of products by Moreali Tessile Casa to third parties (the "customers") are governed by these General Conditions, which form an integral and substantial part of every proposal, order, and order confirmation for the purchase of the products themselves. The sales conditions applicable to the order are those in effect on the date of the order itself.
Any modification related to operations or payment conditions possibly granted in derogation to the General Conditions will be valid only if Moreali Tessile Casa has accepted such condition in writing.
The General Conditions apply to all Customers, except for some provisions applicable exclusively to the Consumer Customer (a "Consumer Customer" is understood to be a natural person who purchases the products for purposes unrelated to any entrepreneurial or professional activity carried out); it is presumed that a Customer who sends a purchase proposal by entering their VAT number in the area related to the Customer's personal data is not a "Consumer Customer". The Purchase Contracts entered into by Consumer Customers are also subject to Articles 50 to 63 of Legislative Decree No. 206/2005.
Moreali Tessile Casa may modify, at any time and without notice, the content of the General Conditions contained in this document: such modifications will take effect from the date of publication on the Site.

PURCHASE PROCEDURE
The order sent by the Customer has the value of a contractual proposal and implies complete knowledge and full acceptance of these General Conditions.
The correct receipt of the Customer's proposal is confirmed by Moreali Tessile Casa through an automatic response sent to the Customer's email address. This automatic email only confirms the correct receipt of the proposal. The confirmation message will indicate the 'Order Number', to be used in any subsequent communication with Moreali Tessile Casa.
As soon as the order is processed, the data contained in the personal area will be updated. Each Purchase Contract entered into between Moreali Tessile Casa and the Customer is understood to be concluded with the acceptance of the order by Moreali Tessile Casa. Moreali Tessile Casa has the discretion to accept or not accept the order sent by the Customer, without the latter being able to make any claims or rights of any kind, including compensation, in the event of non-acceptance of the order itself. The order is considered accepted by Moreali Tessile Casa if, within 48 hours of sending the order, the Customer does not receive any other communications. In case of non-acceptance, Moreali Tessile Casa will notify the customer via email.
By sending the order, the Customer declares to have taken note of all the indications provided to them during the purchase procedure and to fully accept the General Conditions and payment terms described below.

PRODUCT PRICES - DELIVERY CHARGES - PRODUCT AVAILABILITY
All product prices are clearly indicated on the Site and are understood to include VAT. They do not include any other taxes, duties, or levies imposed by the applicable legislation in case of import. In this case, the Customer must take care of customs clearance by paying any duties and taxes (other than VAT) that may be due in the country of import.
The prices and availability of the products listed on the Site are subject to change at any time and without notice, provided that, with respect to orders in the process of acceptance or already accepted by Moreali Tessile Casa, the sales conditions in effect at the time of the order being sent by the Customer will apply.
The availability indicated in the product sheets is not updated in real-time; in the event of numerous accesses to the site, the actual availability of individual products may vary significantly during the same day compared to the indications reported on the Site. Due to these variables, Moreali Tessile Casa does not guarantee the immediate fulfillment of the delivery of the purchased products indicated as available on the Site and therefore will not be responsible for any delays in delivery.
For payments by bank transfer, Moreali Tessile Casa will send the products only when the corresponding amount is credited to the bank account in the name of Moreali Tessile Casa.
If the delivery times of the ordered product are delayed compared to the delivery times indicated on the Site before the order, Moreali Tessile Casa undertakes to promptly inform the Customer via email. Until the moment of shipment, the Customer has the right to cancel or modify the order, exclusively following the procedures reported in their personal area. The cost of each shipment, which may vary based on the delivery and payment method as well as the destination country and the total amount of the order, is added to the total price of each purchase and is clearly indicated and communicated to the Customer before the conclusion of the Purchase Contract, within the Site.
The visual representation of the products on the Site, where available, normally corresponds to the photographic image of the products themselves and is intended solely to present them for sale, without any guarantee or commitment from Moreali Tessile Casa regarding the exact correspondence of the image depicted on the Site with the actual product (with particular reference to the actual dimensions and/or the color aspects of the products).

RIGHT OF WITHDRAWAL
The consumer customer (i.e., a natural person who purchases the goods for purposes not related to their professional activity) may exercise the right of withdrawal (and withdraw from the contract for any reason).
To exercise this right, the customer must send Moreali Tessile Casa a communication within 14 working days from the date of delivery of the goods.
Note: Customers who purchase with VAT cannot exercise the right of withdrawal.
The right of withdrawal is subject to the following conditions:
1. The purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories);
2. To limit damage to the original packaging, we recommend, when possible, to place it in a second box (the application of labels or adhesive tape on the original packaging of the product is prohibited);
3. The shipment, until it arrives at our warehouse, is under the complete responsibility of the customer;
Moreali Tessile Casa is not responsible in any way for damage or theft/loss of goods returned with uninsured shipments. In no case will packages sent cash on delivery or freight collect be accepted.
To exercise this right, the customer must send Moreali Tessile Casa a communication within 14 working days from the date of delivery of the goods.
Note: Customers who purchase with VAT cannot exercise the right of withdrawal.

REFUND TO THE CUSTOMER
Subject to any restoration costs for verified damage to the packaging, Moreali Tessile Casa will refund the customer the amount already paid for the product, excluding shipping costs, through a reversal of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide their bank details (IBAN Code).
During the SALE period and for goods in the OCCASIONS department, Moreali Tessile Casa does not provide for cash refunds on items discounted from 30% to 50%, but after the return of the product, Moreali Tessile Casa will issue a voucher equal to the value of the returned goods to be used within the calendar year. Shipping costs are always excluded from this voucher.
REFUNDS FOR EXTERNAL EU CUSTOMERS
The shipping cost for the return of the purchased product is the responsibility of the customer and for countries outside the EU, the final refund refers to standard refunds.
WHEN THE RIGHT OF WITHDRAWAL EXPIRES
The right of withdrawal expires in cases where Moreali Tessile Casa ascertains:
1. Even partial use of the good;
2. The lack of the outer packaging and/or the original internal packaging;
3. The absence of integral elements of the product;
4. Damage to the product for reasons other than its transport.
In the cases indicated above, Moreali Tessile Casa will return the purchased good to the sender, charging them for the shipping costs.
COMMUNICATIONS AND COMPLAINTS

COMMUNICATIONS AND COMPLAINTS
All communications or any complaints from the Customer towards Moreali Tessile Casa regarding the Purchase Contracts must be addressed to Customer Service by writing to servizio morealitessilecasa@gmail.com
COMPETENT COURT
The Purchase Contract between the Customer and Moreali Tessile Casa is understood to be concluded in Italy and governed by Italian Law. For any dispute, the Judicial Authority of Modena will be competent.
PROCESSING OF PERSONAL DATA (PRIVACY)
For the regulation of the processing of personal data by Moreali Tessile Casa, please refer to the area of the site specifically dedicated to it.
